HB 1250 – CONCERNING A PROHIBITION ON INGESTIBLE MEDICAL MARIJUANA-INFUSED PRODUCTS

Regardless of one’s position on medical marijuana, the voters of Colorado passed a citizen initiative to legalize the use of marijuana for medicinal purposes. Not all patients smoke their medical marijuana. Some, under the guidance of their doctor, ingest it via food products that have incorporated the medical marijuana into the food. This bill would take away that option.

The Gadsden Society believes that, just like with Obamacare on the federal level, the state government should stay out of the relationship between doctors and patients. This bill interposes the legislative’s judgment between that of doctors and patients. This is not a legitimate use of state power. It is an unnecessary expansion of state power. The Gadsden Society opposes all such expansion of power.

The problem, if any, is the inappropriate and over-prescription by licensed medical professionals. There already exists a way to deal with incompetent and/or unethical doctors.

Anyone can file a complaint with the Colorado Board of Medical Examiners if one believes a medical doctor is acting in an unethical manner. I found the form online in about five minutes. The checklist of potential complaints includes “improper prescreptions.” It appears this proposed legislation is in dire search of a solution that already exists.
Just say “NO” to more government power over individuals – even when it comes to medical marijuana.
Contact the sponsors listed above and tell them that this bill – no matter how well intentioned – is an unnecessary and unwanted expansion of state power that comes between patients and doctors.
The bill has been assigned to the House Judiciary Committee. Contact the members of the committee and let tell them to vote “no” on this unnecessary expansion of state power.
